A Dallas County jury awarded $174,114
to the driver of a pickup truck that was struck
by a tractor-trailer while the pickup truck was
pulled over on the highway.
Claudia Guzman had been driving
the pickup truck without a license when it broke
down on the interstate. She pulled over onto the
shoulder. After calling for help from a nearby
payphone, she returned to the truck and was sitting
in the passenger seat when Jesus Martinez rear-ended
the vehicle with his 18-wheeler.
Guzman sued Martinez and his employers,
and then the defendants impleaded the owner of
the pickup truck, Lorenzo Flores. Flores, they
alleged, was aware that the truck was having problems
and should not have lent it to an unlicensed driver.
On Nov. 30, 2006, the jury found
no liability on Flores' part.
